Identifying Family and Domestic Violence
We recognise how challenging it is to remove yourself from a violent situation at home. Sometimes, our clients have struggled to identify their problem correctly. Family violence has several legally-codified definitions, which can help our clients choose to move on and seek damages and order to protect themselves. Family member is a broader term than you might realise. People who are married to one another qualify. But so do cohabitating companions, parents of children, children, relatives by blood or marriage, and those under the care of an adult or caregiver. English law defines family violence as:
· Injury or Property Damage: Anyone who causes an injury to a family member or damages property with the intent of intimidation is guilty of family violence.
· Other Acts of Intimidation: Any acts or threats that cause intimidation or fears for your safety constitute family violence.
· Forced Confinement: Under English law, holding a spouse or child inside their home or anywhere else is a crime and evidence of domestic violence.
· Sexual Abuse: Sexual abuse, as with violence, is a clear-cut example of family violence and should never be tolerated. We can take action immediately to protect your family’s safety.
· Stalking: Stalking is also an example of family violence. If a family member will not leave you alone and makes repeated phone calls or regularly trespasses, you can act.
How Can Our Domestic Violence Legal Advisers Help?
In addition to calling the police, there are several avenues available to family members suffering from domestic abuse. In some cases, contacting our Legal Advisers can help strengthen a criminal case. For instance, if you are the victim of stalking, a Domestic Violence Protection Order or Notice(DVPO or DVPN) provides critical evidence for securing a conviction. These orders can also give the police the tools they need to enact a protection plan that can save your life or prevent injury. Under a domestic protection order, the perpetrator cannot re-enter the residence for up to 28 days. This time is essential for exploring the next steps.
